Bushmans Coat Promotion
- Instructions on how to claim form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Unless otherwise expressly stated, this offer is not valid in conjunction with any other offer.
- Offer is open to Australian residents only. The following are ineligible to claim:
(a) employees of the Promoter (and the immediate families of the employees, i.e. spouse, ex-spouse, child or step-child (whether natural oradoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister or first cousin), participating resellers and agencies associated with this promotion;
(b) Purchasers who are given a discount or special pricing (e.g. tenders, field days and other contracts) or government pricing; and
(c) Purchasers of second quality and auction goods.
- To be eligible, claimants must purchase and have delivered a qualifying Bushmans product from an authorised and participating reseller within Australia between May 1, 2012 and June 30, 2012 (inclusive). The purchase date is determined by the date of purchase printed on the reseller’s tax invoice submitted as proof of purchase.
- Subject to validity of claim, claimants will receive a high quality oil skin coat from the Australian Coat Company valued at $160 inclusive of GST.
- To make a valid claim, claimants must complete a claim form (which may be obtained from the store of purchase or printed off the Bushmans websitewww.bushmantanks.com.au), attach a photocopy of their tax invoice as proof of purchase (clearly specifying the store of purchase and the date of purchase), and send via mail to Bushmans Tanks GPO Box 4218, Sydney 2001 so as to be received by the Promoter on or before 31 July 2012. Any claims received by the Promoter after 31 July 2012 will be deemed invalid. Incomplete, indecipherable, or illegible claims will be deemed invalid.
- The coat will be sent to the claimant by the Australian Coat Company and mailed to the specified address of the claimant. Please allow 30 days from receipt and validation of the claim. It is the responsibility of the claimant to provide the correct details for the mailing of the coat and indicate the size and style of the coat in the claim form.
- The Promoter reserves the right, at any time, to verify the validity of claims (including contacting the place of purchase) and claimants (including a claimant’s identity, age and place of residence) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The claimant agrees that if they have received the coat, they will send it back to the Promoter within 14 days of demand, if they subsequently return the tank to the place of purchase and seek a refund.
- Multiple claims are permitted, subject to the following: (a) only one claim permitted per specified purchase requirement; and (b) each claim must be submitted in accordance with claim requirements.
- Claimants must retain the original of their tax invoice for all claims as proof of purchase. Failure to produce the proof of purchase for all claims when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of a claimant’s claims and forfeiture of any right to participate in the promotion. Purchase receipt must clearly specify the store of purchase and the date of purchase.
- If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
- The Promoter’s decision is final and no correspondence will be entered into.
- If the claimant is under the age of 18 years, the coat will be awarded to the claimant’s nominated parent or guardian.
- Claims and coats are not transferable or exchangeable.
- Claims cannot be made on back orders.
- Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including for negligence), for any personal injury; or any loss or damage (including loss of property); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the offer value to that stated in these Terms and Conditions; or (e) participation in the offer.
- All claims become the property of the Promoter. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, offer suppliers, authorized and participating resellers and as required, to Australian regulatory authorities. Claim is conditional on providing this information. Any details in the claim may be kept and used by the Promoter for the purposes of the "Bushmans Coat" promotion, other marketing and promotional activities conducted by or on behalf of the Promoter, for market research and analysis conducted by or on behalf of the Promoter and for the Promoter to develop and make offers which may be of interest to the claimant including sending electronic messages or telephoning the claimant. Any personal information collected by the Promoter will be held in accordance with its privacy policy which may be viewed at www.bushmantanks.com.au. Claimants should direct any requests to access, update or correct information to the Promoter.
- The Promoter is Bushmans Group Pty Limited (ABN 54 137 242 347) of Level 13, 300 George Street, Sydney NSW 2000.
